Notice under The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012

On 20 September 2022 the County Council intends to hold a meeting of the Lead Member for Resources and Climate Change which will be partly private.

 

The reason for this is that a report to be considered at the meeting (proposal to make an ex-gratia payment)  contains exempt information as specified in

paragraph 1 of Part 1 of the Local Government Act 1972 (as amended)

namely information relating to any individual, paragraph 2 namely information that is likely to reveal the identity of an in individual and paragraph 3 namely information relating to the financial or business affairs of any particular person (including the authority holding that information)

 

Under the requirements of Regulation 5(2) of The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 the Council is required to give 28 days notice of a private meeting identified within the scope of these Regulations.

 

The item (approval of an ex gratia payment) is considered urgent and cannot be deferred as a decision on the proposed payment is required as soon as reasonably possible.

 

For this reason compliance is considered impracticable, and an exception to

Regulation 5(2) is therefore sought under Regulation 5(6) of the above

Regulations.
